Recently with the government shut down in effect a number of our clients have been reaching out to us to ask how it affects them. As is common for any attorney directed question, the answer is “it depends.”
First and foremost, all IRS due dates and deadlines remain in full effect! That means if you have your personal taxes (Form 1040) on extension they must be filed by October 15th…regardless of whether the government or the IRS is back in operation. The same holds true for all other tax due dates such as payroll and other business-related filings. Those taxpayers with installment agreements are still required to make their payments on the due date. Failure to do so may result in the IRS declaring a default. Also, taxpayers that had agreed to due dates with Revenue Officers, Appeals Officers, etc. must still meet those deadlines.

Taxpayers should also be aware that the government shutdown of the IRS will most likely create a backlog that will take some time to clear out. They should expect delays in the processing of their returns, amended returns, approval of resolution options, such as installment agreements and offers in compromise, and requests for Collection Due Process hearings.
